NEM5 ("we," "us," or "our") respects the intellectual property rights of others and expects our users to do the same. We respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (DMCA).
Reporting Copyright Infringement
If you believe that content on NEM5 infringes your copyright, please send a written notice to our designated DMCA agent with the following information:
Required Information:
- Identification of the copyrighted work: A description of the copyrighted work that you claim has been infringed.
- Identification of the infringing material: A description of where the material that you claim is infringing is located on our website, with enough detail that we can find it (e.g., URL).
- Contact Information: Your name, address, telephone number, and email address.
- Statement of good faith: A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- Statement of accuracy: A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
- Signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

Counter-Notification
If you believe that content you posted was removed or disabled by mistake or misidentification, you may file a counter-notification with our DMCA agent. Your counter-notification must include:
- Your name, address, and telephone number
- Identification of the material that was removed and its location before removal
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
- A statement that you consent to the jurisdiction of the federal court in your district and that you will accept service of process from the person who filed the original DMCA notice
- Your physical or electronic signature
Repeat Infringer Policy
NEM5 will terminate, in appropriate circumstances, the accounts of users who are repeat infringers of copyright.
False Claims Warning
Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be subject to liability for damages, including costs and attorneys' fees.
Response Time
We will review all valid DMCA notices and respond within 48-72 business hours. If the notice is valid, we will remove or disable access to the allegedly infringing material promptly.
